On Wednesday, June 15, 2022, at approximately 2106 hours, Liberty County Sheriff’s Office deputies were dispatched to a residence on CR-331 in reference to a theft in progress. The caller advised that there were three (3) suspects attempting to steal a yellow Ford tractor. A deputy observed a chain that was connected to the tractor and a white Toyota pickup. The property owner advised that he had not given permission for the suspects to be on his property. He also stated that he had not given anyone permission to remove the tractor from his property.
The suspects were identified as Robert Graggs, W/M, DOB: 08/16/1979, (who owed the pickup), Noah Niemeyer, W/M, DOB: 06/05/1979, and Emma Suess, W/F, DOB: 04/26/1997. All three suspects were arrested and charged with Theft of Property – Class A Misdemeanor. They were transferred to the Liberty County Jail without incident.

(a) A person commits an offense if the person enters or remains on or in property of another, including residential land, agricultural land, a recreational vehicle park, a building, or an aircraft or other vehicle, without effective consent and the person:
(1) had notice that the entry was forbidden; or
(2) received notice to depart but failed to do
LCSO documents this type of notice by giving a written criminal trespass warning signed by the property owner and the violator.
If the offender violates the written notice they will be filed on.
We have found that if this notice is not in writing the prosecutors are not as likely to accept the case.
